Go to the City that you live in and ask about zoning restrictions. I work for the City of Austin and I used to work for Building Plan Review as a coordinator and Zoning Review was the office next to me. That's your first step. I'd try looking up a number and calling them first :) Good luck!

yes as long you are not blocking anyones light you can build up to 6 feet in either brick or wood or even a metal railing good luck with your problem
