My father in law is about to go through a divorce. His wife has been unfaithful many times and taken her back many times. She has a drinking problem and he keeps trying to help her. She just cheated again and they are now divorcing. Is there any chance he wont get messed over with alamony since they have been married so long. She is going to try and take him for everything and he has been good to her. She has a parttime job and will not get a fulltime job when she is fully qualified to get one and suppoert herself. I guess the question is does he have to get the short end of the stick on this since he isnt the bad guy here.

She is the one that cheated.He needs to find a good lawyer and she won't be able to get anything.

Divorce - in any state - is a case-by-case kind of thing and you can't get an answer upon which you can rely by posting here on the Internet. You haven't provided enough facts and there is no chance to question you further. (Basically, all you have asked here is - "hey, my father-in-law is a really good guy - will he get screwed by getting divorced in Virginia?" It is just not possible to answer that question.) You need an attorney - well, HE does.

If the parties agree to be divorced, you must have a written Separation Agreement that makes adequate and sufficient provisions in writing for the custody and support of the minor children of the marriage and makes a fair and equitable division of your property. If there are no children, and an agreement, you can file for divorce with six month's separation. If there are children, or you and your spouse cannot reach an agreement, you have to be separated for at least one year. There are also additional technical requirements, but the Separation Agreement is the essence of an uncontested divorce.
