I have invested some money on 2 propeties in the city of Macon, Georgia and they are about to be sold. I need to file a lien on the properties befgore they are sold for numerous reasons, but I live and work in New York? Can I do it over the phone? Who do I call?

I am not a lawyer and can't give legal advice. But I have filed Liens in Georgia and am familiar with the procedures.

Call the Superior Court Clerk for the county the properties are located in, and ask to speak to the person in charge of recording liens.

As a general rule, you want to send an original to be recorded, with the fee (small) and a return envelope, so that they can send it back to you with the recording stamp on it for your records.

You can't do it over the phone... fed ex is probably your best option, since they will probably not take a fax. You can ask though.

When you say you invested in them, do you hold title to them? If not, in what did you invest? Are you a partner? What you need to do is file a lawsuit against the selling partners, and then have that complaint filed in the land records as lis pendens to prevent the sale (no one will be able to issue a clean title insurance policy until the lawsuit has been addressed). But you better have good grounds for the suit, or you will end up paying lots of legal fees and perhaps damages.

You need to contact a title company in Macon and have them prepare the liens for filing and pay them to file them. They will probably require proof of the investment in the properties.

call your local bar association for an attorney that is licensed in the state that you need to get the lien in.
