Yes, you can sue somebody for a cellphone.
The US constitution guarantees you a right to jury trial if the amount is more then 20$:
7th amendment says
"In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved"[1].
If you are under 18, you mother can bring a suit on your behalf.
For a case like this i would recommend small claims court.

I dont get with all you people an sueing. It is getting annoyin. You liberals sue for anything... spilling coffee, sueing mcdonalds cause u ate there and getting fat. You need to settle down. I mean a cell phone getting stolen. I bet ur sueing for the money not because he stole ur cell phone. But u can sue someone. Its stupid tho

It has been my experience that one phone call form a police detective in a situation like this will get your phone back. You do have the option of filing a small claims lawsuit for the value of you phone, the cost of monthly services charges during the time you were denied use of the phone and the cost of any calls made on the phone. I would also call the cell phone company to cancel the phone so they your ex-friend can't use the phone.

If your cell-phone has personal photos,or information that you need,than you probely could sue your x-friend. Its called "Invasion of privacy",and if someone has your information,they could try to use it against you. So,yea go ahead and sue. Good Luck.

Absolutely. Although, I would first cancel the service so your friend can't make calls on it. Then your mother can file in small claims court for the cost of the cell phone (and the cost of the service while your friend had it). She can also file a criminal complaint.

no. you can not sue her. You can press charges and have her arrested for theft. but theft is not a civil issue unless she somehow does damage to you. for example using your cell phone to call people and say things about you that harm you permanately.
Call the police and have her arrested is the only option.

Sue for what? You can have her arrested. They only thing you can sue her for is if she is using it to make calls then and only then can you sue her for the calls that she made.
