My ex husband owes a couple of thousand of dollars in back support, today I went to friend of the court to have them help me collect it. They told me because I was not receiving welfare that there is a no enforcement policy when someone is recieving SSI! Is this true has anyone else heard of such crap? If this is not true how can I fight Friend of the Court decision?

They cannot take money out of his check but he can be forced to pay just because he gets a check does not mean he doest have to pay, consult a lawyer you will have to go to court to inforce this but it can be done, you need this extra to take care of his children fight hard you'll get it i know personally"

Seeing that your husband still has to claim taxes every year, because he still gets an income. What you can do is go after his refund if he does get one. Now if his payments were made through the state and then mailed to you, you would need to call the child enforcement unit of your state. They are supposed to be able to tell you on how you can do that. Also you can take him to court yourself with.without an attorney and claim you are not getting anything. Just file a complaint with the clerks office and pay the fee of whatevere it is now adays and they will schedule you a court date. You may also want to pay extra to have him served the papers legally as well seeing he may claim he never got any papers. I had to do this same thing really, but I didn't have to go as far as court the state just kept his refund and sent it to me. It was over a thousand dollars.

In Texas, a man on disability is not required to pay child support, SSI will pay give each child a monthly check though. This is the case for my SIL's, live-in bf. He gets monthly SSI checks, as do each of his 3 kids from previous marriage and now his and my SIL's daughter together.

As far as I know if he is getting SSI, then you are entitled to SSI for your children. It depends alot on your state laws. What you need to do is talk to your local child support enforcement agency. Or your Attorney Generals office. Good Luck.

That is a lie!!!! My aunt's 2 kids' daddy draws SSI and they make him pay child support out of his check.
But for 2 kids he only has to pay $160.00 a month for them.
That is a lie though or then again it could be different from state to state.
I would look into it though..Call a lawyer or the welfare office or take him to court.
He has income so he has to pay.

haha i got $2000 back last setepmber cause my father was on SSI, but it kinda sucked in my situation, cus he ows my mom back child support, 250 dollars each for my sister and i a month, and this has been going on for almost 9 years lol. But his only sourse of income was his retirement thru the postal service, so my mom couldnt touch it cus it was his hard earned money.

OK first of all there is two types of ss It all depends on which one he gets. This is my advice to you is set a court date and let the Judge know whats up and the court can order whatever the courts want to do. Remove all doubt and go to the courts. Every state is different and so is every case.

that is a bunch of crap. If you go to court for it, they will take it out of his SSI pay. They are doing it to my father for back child support right now, and I am almost 30!

Where do you live?I am in South Carolina and they don't encourage women to be on welfare to get child support. If you have a court order for child support they need to enforce it, you need to go to the the Department of Social Services of Family Court cuz if he was in South Carolina his *** would be in jail.

I get ssi and they take my childsupport payment right out of my check every month witch i don't mind cause then i don't have to worry about it not being paid they should be taking it stright out of his check every month you deserve that money and just because u are not on walfair that should not even matter i think u should got to your local social security office and talk with them best of luck hun hope you get him to pay
