because if u think about it they say u cannot buy cigs under 18 but no smoke under 18

There is no smoking age in some states. Laws usually pertain to underage purchase. I've tested it in a few states.

You have to be 18 to buy them, and socially you should have to be 18 as well.

There are big signs right on the door of most gas stations (in TX anyway) saying "Buying for minors is not only wrong but illegal" I also think you can lose your drivers license if you are caught buying for a minor.
