yes. in all states but two. its called brandishing a weapon even though its in the open. you still must have a concealed weapons permit to carry a gun. the only exemptions is in a case going hunting and to and from fishing in most states.

I don't know about the actual legality of it, but even in places where it's technically legal, you're unlikely to get away with it. That's unfortunate, in my opinion, but it's today's world.
