If your partner does not have herpes then no you can not get it.

The only way you can get genital herpes is by sex and direct skin to skin contact.

If your partner has any type of Herpes, whether it is genital or Oral (cold sores), you could get either one from them. It is easily transferrable from oral to genital if there is contact between those two body parts during sex. It can even be transferred if the partner with herpes does not have a break out at the time of sexual contact. If you or your partner think you may have come in contact with this virus, go and have an STD test done for both of you.

While having genital contact is the proven way to contract genital herpes, you can also get another type of herpes from oral sex and cold sores.

That is true. But it is very hard to tell if your partner has them, since the sores only come up every once in a while. But even when the sores aren't there there is still a chance you can get them. So you should really find out if your partner has it before you do anything with him/her. But if they don't have it, there's no way that you can get it.

Yes it is transmitted thru sexual contact, but if that person got it from someone else they spread it even though they don't get outbreaks. Which means you can get it.
