And a "prophesy must come true" isnt an answer. There was a penalty. And just for clarification, I am asking regarding Old Testiment Prophets. There was a penalty by law if a prophet was wrong in his prophecy.

First, your question needs to be more specific. Numerous societies have had (and continue to have) prophets. I assume you speak of the Old Testament Israelites, but there is no way to be sure without clarification.

As for penalties for inaccurate prophecies, I really doubt there was any such thing. Prophecy is intentionally vague and ambiguous, so that the events that transpire can be made to fit the prophecy. If Isaiah prophecied that God would punish the children of Israel, then whatever bad thing that followed - flood, famine, exile in Babylon - could be seen as fulfillment of that prophecy. Given the instability of the times, it would not have been long before something like that actually happened.

Also, prophecies don't really come with timelines. Prophets never said "next wednesday," or "you have ten days." Otherwise, they could be made to look bad. Given all the vagueness, then, it would have been impossible to disprove a prophet. Not that the superstitious Israelites would have dared do that in the first place.

Deuteronomy 18:20 But the prophet, which shall presume to speak a word in my name, which I have not commanded him to speak, or that shall speak in the name of other gods, even that prophet shall die.
21 And if thou say in thine heart, How shall we know the word which the LORD hath not spoken?

Why wouldn't all prophets, not just the false ones, be banished to the eighth circle of Hell for using methods of divining the future?

If a "prophet's" prophecy didn't come true than he/she was not a prophet.

Nothing. They usually just explained why it didn't happen. For religious prophets, the reason it didn't happen usually meant that the people were sinners or not worthy. Viola!
