If you are in the military and your legal residernce is another state but you are stationed in California, does it matter where you file? And what would the process be?

The same way you would in any state as it is a federal issue. You need to decide which chapter you want to use. You should consult a lawyer and they will show you the correct options.

I think it depends on you domicile state, the state in which you intend to return to to live in permanently, California is just somewhere you reside in. And it does matter where you file because CA law has changed in bankruptcy a lot since last November...you need a lawyer...or a legal document assistant...

I'm sorry about you having to file for bankruptcy.....but please realize that this will make your credit go bad for the next 7 to 10 years. It should be your absolute last resort. If you haven't done this, try calling your creditors, and making a payment plan, at a reduced amount. You can do this with each one......9 times out of 10, they'll want to work with you.
