Im trying to figure out what the implications are for a father in the USA who is paying child support for his kids (2 girls) but has arrears due to career transitions and all. I understand he is not able to leave the country (he says); they wont let him do that while he is paying child support? I dont understand how this works and how long you keep being barred from travelling? He is very much a part of his kids' lives and he has them every summer. Can you actually get a passport while your owe child support money? Please shed some light.

It does depend on the particular state laws where you live. However, you as the recipient of the support can waive the arrears if you so desire. Get in touch with your Friend of the Court (In Mi. this is our system, not sure if its the same in other states!) they may require you to write a notorized letter with the amount of arrears to be waived and also a copy of your drivers license. You also have the option to opt out of pay support through the court system and handle your case responsibly with each other, as adult and parents.

Its not about him paying the child support, its about him owing. If he has substantial arrears and hasn't made payment arrangements, the government can suspend licenses, (not just driver) passports, automobile registrations, and the like. If he has cleared up the arrears then they will restore his passport as soon as that is done.

Depends on what state you live in, and even what county if he is not allowed to leave the country he owes ALOT of money, I was behind $7000 once and in Ohio where Im from I can lose my drivers license, goto jail, and pay fines for being that far back.

child support payments should have no effect on his ability to leave the country or get a passport. The only requirement is that he may have to notify the mother and the state in writing if he decides to move permanently.
