A friend of mine is about to go through a divorce father lives in Texas..mother is an english citizen..child was born in Tx and is 2 yrs old..6months ago father and mother seperated.Father gave mom written notorized permission to take child back to england with her and has not had much contact with them. How does the mother go about filing for child custody? She is applying to get the childs dual (England)citizenship. At this point it is believed the father will give her custody. Who will have jurisdiction and where will she have to file for the custody at? The Texas courts or English?
Thanks in advance for any help from anyone who has encountered this.

Well, if a child is born in the US (parent's nationalities are not an issue at all) or if the child is born elsewhere to an American citizen, the child is automatically US. Period. Not sure how that works in England, but I imagine it would be similar.

I don't believe the issue is a state one since it crosses international borders, but it would be decided in federal court (on the US side) and something very similar in England. Remember, our judicial systems are very similar since we copied them way back when. The English embassy would be a good place to start (for here) and the American embassy in England would also be a good place to start. They should point out the right direction.

Contact a lawyer, but I think if the father is in the states she has to file here, I adopted a child and had to file in the state we lived in not the state she was from, not sure if that helps or not....Good Luck!
