Say a marriage is breaking up and the wife starts a business the husband has nothing to do with it ,when I leave him is half the business his

It depends. Are you in a community property state? Is wife using her separate property funds to purchase the business? Will husband be contributing any consideration toward the business. i.e; money, time, effort, etc.

If I were in your shoes, I would wait until I was completely divorced until I started a business.

It depends, if he doesn't help you at all and is not an employee than he may not be able to get any of it. If you have been running a business for a while and he helps you with it than yes he may get compensation for a percentage of the business. The best thing is to talk to a divorce lawyer that deals with independent business owners.

yes if she started the business during the marriage and you helped it to grow then yes. And you signed no parimutuel and or waver to give up any part of it. But if you put nothing in to the business and did nothing for it then the answer is "NO" because you did nothing to help her. BUT if she started it on your credit and income say because she may not have had enough credit or the income to support it. Then the answer is "YES" you are (1/2) owner of the business. Guess it depends on the state and the judge but here where i live, anything accumulated during the marriage is split down the middle.. so if your tech. still married then more then likely he is entitled to half, go seek a lawyer to find out for sure..

Yes, it probably is. Ask your divorce attorney about this. Anything you have before you are divorced may be half his. Better to find out the facts before you are sorry.

it can be arranged during divorce proceedings.
he can say he supported your idea all the time, making it half his. Same way that a woman get half of man's stuff when she stays at home all the time.
