Take it to small claims court. Anyone with a conscience should return the ring. It was given as a 'promise' of marriage. If there is no marriage and no longer a promise, the ring belongs to the purchaser.
Of course if the person who gave the ring is also the one who broke the engagement, the receiver of the ring did keep her promise, so by law may have a right to the ring.
Morally she does not.

The common misconception is that the ring is a gift. It is not. It is a contractual element that goes with the agreement to get married. The wedding finalizes the contract. The girl may be able to keep the ring since she did not break it off with them guy. It would be up to a court to determine if she should have to give it back. Regardless DONT sell it. If the guy takes you to court then a judge could order that the amount that was paid for the ring be refunded to the guy. The best thing would be to give it back and cut the ties with the guy. He has already caused enough pain no sense and letting him cause even more pain.

Legally, a gift is yours to keep. You don't have to return it. But why would you want to keep a ring given to you by a guy who broke off your relationship? The mature thing to do would be to give back the ring and go on with your life.

legally speaking, sorry i cant say for sure, but the ring Was given in the intention of the marrige to happen. Why a girl would want to keep it is beyond me, its a part of life thats over and done and i am sure it wasnt pleasant for anyone...maybe spite? the cerimony never took place so i would figure its the rite thing to do, but u know some chicks....$$$$...spiteful,spiteful,spiteful

If she breaks off the engagement/wedding, she has to return the ring. If he is the one who ends things, the ring is legally her's to keep. My personal two cents: why keep it? If he wants it back, give it back.

Depends.
If the guy just "gave" her the ring, it is hers and she keeps it.
If it was given on a gift-given holiday (like Christmas) the argument can be made that it was a present.
If, however, the guy says "this is my ring and you are welcomed to wear it so long as we are together", she must give it back.
Good luck proving that though...
