It is my understanding here in California that if a tree from a neighbor grows over onto your property, you have the right to cut that portion that infringes on your side. Of course, working it out with your neighbor would be most diplomatic.

In most states, if the branch is over the property line, the neighbor with the branch extended has the right to cut it back to the property line. It's always best however, if the tree owner does it instead. That said, check the state listings, if the owner is being uncooperative.

This happened to me last week. The neighbor was kind enough to cut the branch because the tree was in his yard. However, my son had this happen to him last year and he had to go next door to ask what would be the best solution. This neighbor told him to cut it down if it was in his way. The best thing is to talk to the owner of the tree and come to some agreement.

If a branch of a tree is hanging over someone's property and falls, damaging some of that property, the person who owns the tree (the land the trunk is on) is responsible. If you own the tree, it's your responsibility to keep it trimmed.

If the branch is closest to your property, you can cut it. If it's way out infront, in the street, the city should.
