It is leased. The lease was signed with the Cuban government that came to power after the Spanish-American war in 1898.

Way back when, before Cuba was taken over by Castro and his Communists the U.S. entered into an agreement with the then friendly government of Cuba to lease Guatanamo Bay for the sum of $1.00 a year ( I think that figure is right ). I am not sure how long this lease is for however.

We were allies of Cuba before the revolution an Fidel sized all property belonging to US companies and citizens. Since we had a lease with the Cuban government prior to this coup and the navy was there and we stayed There is a lease and we may need to leave like the Brits left Hong Kong.
