Regarding the Creative Labs Zen Vision:M and gapless playing...?

Is gapless playback something that could be fixed with an upgraded firmware later on? or is it a permanent problem?

Yes, it could probably be fixed with a firmware upgrade. I use MP3s, not copy-protected WMAs and I've not really noticed a gap in the music.

it can be added later on with a simple upgrade just for the fact that creativehas the worst firmware
