Talk to your child support worker or lawyer. In MN, I believe that it is 2 years with no contact at all, not one phone call, letter, gift and not 1 penny of child support. Then you can petition the court to terminate rights.

Since he paid child support however erratically,legally you would have to prove in court that his rights somehow are detriment to the child.From what you say,he never sees the child anyway,just leave him alone.If he should appear later demanding his rights,sue him for back child support as well as petition the court to terminate is parental rights.
