If a father ha been ordered to pay child maintenance and has not done so from the childs age of 2. She is now 33. Does the interest accumulate and if so what if it adds up to a large amount that has to be paid from his estate when he passes away what happens to the other beneficiaries if there is not enough to cover everything.? Does she also have to be informed of her fathers death even though he has left nothing for her in the Will as they were estranged and states clearly that nothing should be given to anyon except those named in the will. Would the money go to the child or her mother?

If paternity is established, she can contest the will...as for support monies...since no attempt to collect (I assume to be the case) has been successful...those will be forfeited, classic time bomb for the dead-beat dad family. believe nothing you read on this subject in this forum...see an attorney, it will be worth the expense.

There is no way of claiming child maintenance retrospectively; why didnt the mother claim while the child was still uder 16? After 16, in UK, it stops anyway- nobody pays maintenance for a 33 year old!
The logical thing to do is to see a solicitor. If the father is dead and has not included the child in a valid will, I think theres nothing you can do, but ask a lawyer.

This is not a question which can be answered by anyone on this site.
You really need to contact a Solictor or Lawyer that specialises in Family Law.
You have not said where you are. Remember that Scottish Law is different from English Law.

Because the child is over 18, I believe the money would go to her. You really need to talk to a lawyer.

Sounds like a good question to ask a lawyer in your particular state.

you need to talk to a lawyer and evaluate your own morals.. sounds to me like yet another situation of a deadbeat dad and family members trying to stiff a child for what they deserve in life.
