he probably got attacked by a bear and is hurt somewhere, dont stop or declare hes dead till you find a body or bones, most missing people who got lost in the woods are stuck somewhere and need help, dont give up so soon, i would never!!

I am sorry to hear your brother is missing.
Check with the Sheriffs office about how to go about finding out about when he can be legally declared dead.
Do remember that people go missing for a good many reasons and some of them go missing on purpose. So don't be too quick to draw any conclusions.
I am sure there are some good legal reasons why this remaining undeclared may make life harder for you or other members of his family but don't jump too quickly to any conclusion.

In most places it takes 7 years for a person to be missing before they can be declared as dead. This is to prevent persons from faking their deaths in order to collect on life insurance. You need to talk to an attorney or a state agency to get details for your area.

He has to be missing 7 years before any form of death certificate can be issued. You can place him as missing, and i think get documentation to enable you to pay the house mortgage (if it is in his name), and the like.
You probably will not be able to get insurances from any broker intil the 7 years are up (or everyone will dissappear and claim insurances!)
