I am filing for chapter 13 and I just got a used car. If i file for chapter 13 will the creditor reponses my car. Also, I have one of the creditor ganishing my check. what do you think people!

I am filing for chapter 13. I had just purchased a car on May 2006; making monthly payment. It's a used car. Also one of the creditor is ganishing my pay check. the only income that, I have coming in. My question is that, If I file for chapter 13 and include my car along with the other creditors will the creditor take my car?. This's the only car that, I drive to go to work. This is my first time of filing chp 13. Please Help! for explaination. Thank you.

Chap13 is a Plan...In that plan you propose who you are going to pay and how much....You can propose to pay the car payment outside the plan - just include it in your budget and you may have to reaffirm the debt......
However, if you were able to finance a car so recently, you may find the Plan to be a full five years and every single penny of your disposable income committed to the Trustee every month for the next five years......tread carefully.

you will have to put it down as an asset and that you use it for work check with the attornoy on the chapter 13 for their is some gudie lines and to make sure you ask.
