They are not illegal everywhere and in every circumstance. Some fireworks companies (such as Grucci) are based in New York. As long as they don't sell them illegally, they can make and sell them. It's illegal for YOU to have an Ground-to-Air missile, but the government won't shut down the makers because the government buys them.

The people who do have them get them out of State (Pennsylvania for example) and bring them in state. Then they sell them in alleys, from houses, from cars, from whereever they can and not get caught. Not ALL are successful.

Police don't generally go after the little guys because which would you rather stop - Joe Smith who went and got $500 worth to put on his own illegal display or Jack Johnson who spent $50,000 with the hopes of distrubuting them? It's kinda like drugs - you don't generally go after the little marajuana only dealers who sell it by the dime bag - you go after the big guys who bring it in by the tons.

You get them by going to a state where they are still legal. Around the 4th of July cops are a little more lenient about the fireworks because they can not spend all day gong from house to house just for fireworks. Usually they don't do anything unless your neighbors call and complain.

People sell them illegally. Or people go to states where they can buy them legally, then bring them back to where they live.
