her rent is only $300-a month for a room i had advertised for $450-but she complained that the $300 one was small so I let her have the better one at the same price-as well as waived $150- sec dep-free first week rent-groceries$40-cable-high speed internet-all utilities-and of course when i see her -my friendly demeanor-we met on myspace-she was flirty-messages-etc-.i had a couple rooms avail-she told me she was with her brother"in a bug infested-dirty dishes-pig sty-that he was nasty to her and her 8 yr old boy and that he stole her things and locked her out -mean wile she was currently "abandoned"at an extended stay apt in what was truly a bad area-so "capt save a ***"to the rescue!!!she moves in -I appearantly "did not look like my online picture" worse ,as I have figured.and now I have roaches literally jumping on my back from her filthy habits[trash] and she is $450 behind in rent!

You have to evict her just like a tenant....

Give her a 3 Day Notice to Quit or Pay Rent....that starts the legal clock.....Next to encourage her, by canceling l the cable, the internet and empty the fridge, cancell the landline phone too......

You need to get your stuff securedso you can spray once she moves out.....and she can't steal it.

Go to your Secretary of State website.....or the library....There are numerous evictions books specific to each state out there..

I evicted my tenant in 19 days start to finish and did not use an attorney......Whatever you do, start the legal clock now!!


You can create your own "pleading" on Word or find a 3 Day Notice on line to copy......get it done and serve her today!!!! because the clock won't start until tomorrow....And get your valuable stuff out of there (tv, CD's, DVD's, etc.)

You got scammed, and conned big time.

Lastly, in AZ, I had to give my tenant a letter "notifying" him he was late and then 5 days later I could serve the 3 Day Notice ....Each state is a little different....Go ahead and at least give her formal notification that she is late, in writing, today!!!

Some states have 5 day notice to quit, others 3 days.....google landlord/tenant and your own state, and get her out of there.

Also, make sure you don't have any financial stuff around (checkbooks, atm cards, social security cards, anything like that) she could be copying the info down and screwing you later.

If she did not sign a lease you can call the police and have her removed for trespassing. If she did sign a lease, depending on how your lease is worded and the state your in, you can issue her a three day notice to correct problems and also for non-payment of rent. When filing with the court, I would include all past monies owed, and the upcoming month of rent. Also, I would do an inspection of the unit and include any cost for damages that are noticeable. Take a camera when you do your inspection, so you'll have pictures when you go to court. You want to include all monies when you file with court. This way when you get your judgment, all past and future rent and damage monies will be awarded to you. I'd contact a lawyer ASAP. You must issue her notices. You can get sample copies of all letter and a renter/tenant handbook from any lawyer. You can also issue warnings on her disturbing other tenants. The BEST option for you is if there was not a lease signed, call the police and have her removed immediately. I'd go to her first and let her know what your plans are because of the child. This is not a good situation for anyone involved. Explained if you do go to court she will also be responsible for all attorney fees. If an Eviction does take place, the sheriff will literally come and put all of her belongings out on the street. Her best option is to move. You must put everything in writing and I'd have it served to her by a private processer.Good LUCK !!! Be very firm and let her know you will not revisit this issue with her and to get out.

Do you have a lease with her? If so, you may break it if she is violating the terms of the lease...She is since she is behind on rent.

Serve her 30 days notice of eviction.

Even if there is no lease, you must still give her 30 days notice. You may sue for back rent even after she is evicted.

You need to consult with an attorney before you do anything!

You may need to go through the courts to get an eviction if she refuses to leave voluntarily. Locking her out may be against the law and if you do that you'll open yourself to a mess of legal problems.

Get proper legal advice; you need it!

Sell the condo. Buy another. Learn your lesson. To do anything else requires courage, spine, backbone, bravery. If you SELL IT, you can carry on your "friendly-front", without stepping on any toes. Just do it.

If she is behind, you can give her notice to leave. If she doesn't leave, remove her stuff and change the locks. Check with landlord laws. Get rid of her.
