It's illegal in every country unless you pay for it (example, itunes), as it violates international copyright law. If you insist on downloading, go to http://www.limewire.com, download the software, and use it. It's still illegal, but I don't think the Indian government is going against it much.

I don't know about India, but in the US downloading music is only legal if you pay for the music. Some legal programs people use are itunes and napster and some illegal ones are limewire and kazaa. I don't know if any of these are avaliable in India, though, sorry.
