I know of some people whose son was killed in Iraq who had to take the email company to court to get the psasword, and even then it ws denied and appealed. I don't know of final outcome.
Contact yahoo customer service and find out their guidelines regarding that and what you would have to do.

Most email's will go invalid after so long if they are not opened or accessed.
The easy way to find out is to send an email to that address asking the user to respond. Be sure that you let them know that yu are trying to check you late fathers address. Maybe they will respond if someone else is using that address!!
I know that my moms was invalid a year after she passed.
