Is it legal to file two seperate pettions for the same person concurrently (for green card):
a) pettion for an alien relative(I-130) ,who is infact an unmarried daughter ,over 21,of an american citizen.
b) the very same person who is also an H1B visa holder,under EB2 category by herself/employer(for greencard purpose).
I would appreciate answers .Thanks.

No. It can cause a lot of problems and may even result in the person never being able to apply for a green card. Talk to an immigration lawyer. they will figure out the best option.

This is not an expert opinion but an opinion nonetheless: I think it is illegal. You can only petition a person using a category. Given your options and if the person is in the States now, go with the H1B1 to EB2 because it's the faster way. Faster primarily because it is not exclusively categorised and dependent on the petition priority date and I have known a number of people who got their permanent resident status in a matter of 2 months to 1.5 years.

if you're married, or not married, to an american citizen. and you have a baby, that baby becomes automatically american citizen.
if you're an elligal, and you have a baby here in the states. that baby is a citizen. it is elligal to file these pettions. you can not keep filling pettions,. if they catch you they will take away your GREEN CARD!

It is not illegal to file two petitions for immigration, if the beneficiary will qualify in two different categories. It takes a lot more than this to confuse DHS, or a consular officer.

No i don`t think so i myself am a green gard holder I was told not to file more than one petition the us government does not like to be confused i wouldn`t advise it
