My sister is going to Canada with her kid and never married with the ex. Her son has a US pasport and birth certificiate. Does my sis still need her ex consent to take her son to canada for vacation?

Well you said unmarried then the term ex so I assume you were once married.

Irregardless, even if there is no joint custody, because you are taking the child out of the country, you do need to get approval. Talk to a family attorney. There are some forms for this that are simple and easy.

Btw, since your child has a passport already, you could actually go for a visit without anybody knowing. I mean no one is going to stop you at the border for it.. not the Canadian border. I just would make sure to come back because say for example, you tried to move there without consent, then you would get into major doo doo.

It depends. You can have joint custody, but it depends on who has primary custody. Who does the child live with? The parent who is the responsible party and gives the primary care of the child is the one who has primary custody. Unless it is a stipulation in the custody papers, that parent does not need consent.

Yes she does even if she has full custody. The father is going to think she's trying to move to Canada and separate him from his kids. It would be the considerate thing to do.

I wouldn't think so..not for a vacation. If her ex has parental rights...ie: he signed a birth certificate, or has exercised his rights in any other way...then he probably has visitation, and will need to be told that the visits are cancelled while she is on vacation....
If not, then no worries. Moving permanently is when you need permission...from the court if the ex denies.

If they have joint custody, yes, get a notarized approval to travel. That would be best.

Sole custody would have to be shown even if the father was dead, if you don't have approval. It may not need to be notarized, but it doesn't hurt.

I suggest that she tell him where she is going to take his child, especially if it is out of the country. As to whether or not Canada requires it, I dont know.

I think she does. I know one guy who had to have his step-son's biological father's permission for the step-son to join him and his wife during his assignment in Germany.

NO CONSENT NEEDED, UNLESS THE OTHER PARENT HAS PARTIAL CUSTODY OR PAY FOR CHILD SUPPORT.
