Your best friend may just think this is the best thing that ever happen to her brother. Lot's of people meet people in this way. The only problem I can see is your BF might become resentful because you are spending all your time with the brother and not enough time with her.

If he's not with someone and if it's not illegal (age or otherwise) then sure you can. You can't help who you love. Just be careful. If you do get with him and then it doesn't work out then it can seriously hurt your friendship with your best friend.
