I have been married for 4 years and became US permanent resident two years ago. Conditional status has been removed when I got my green card two years ago. But since my husband refuse to have sex through all of our marriage, I want to get an annulment or divorce.

I would rather get an annulment on my marriage than divorce.

You need to consult an immigration lawyer.

A divorce will not affect your status but if you get the marriage annulled and that was the condition upon which the permanent residency was issued it will appear as though the marriage was not entered into in good faith, that could trigger a review of your residency status.

Since you now have permanent (rather than conditional) residency, dumping the creep will NOT affect your status. Nor will it affect a future application for citizenship. You are a permament resident, plain and simple. So go for it, divorce or annul, it makes no difference, and good riddance to him.

And by the way, if you leave him two years after you acquire permanent residency, neither you not he will never be accused of or prosecuted for marriage fraud.

Yes, if the conditions have been removed, you'll have nothing to worry about, the green card is still valid.

Divorce does not adversely effect an alien's immigration status after the alien obtains permanent residence unconditionally. The only affect divorce may have on an alien at this stage is that it may delay the alien in obtaining citizenship.

Annulment means the marriage is null and void; therefore, since the marriage had never happen it could affect your resident status

divorce should not affect the your permanent resident status.

If there were no sex that means the marriage has not been consummated. Which means there is no marriage.

1 call the local immigration office.
2 call a lawyer that specializes in this
3 the rule of thumb is after two years (livingin the US as a spouse), you cannot be deported
4 your admission about no sex for the two years, CAN affect your case, it is a sign that you were not in a REAL marriage, but one contrived to defrausd the US government for your residency
5 an annulment might affect it as another stated, because you are requesting that the world view you as NEVER having been married, hence your reason for residency has been voided as well
6 even if you are allowed to remain, it can affect renewal of your 'green card' (they have not been green since the early 70's!) and force you to leave at that time
7 it can possibly affect your application for citizenship (like point #5)

Good luck and thanks for wanting to be legal (unless you DID just get married for the ability to come here, in that case I cannot wish you to stay ,as that is fraud)

I think (I'm not sure!) that divorce would not affect your green card. But an annulment probably would, since that would imply you were never really married, and consequently may not have ever really qualified for US Resident Alien status.

You need a good immigration lawyer. Tread very carefully!

Be wary. This sounds like marriage fraud. That is a felony for him and a one way ticket home for you.
