No it is not illegal to sell a car with a defect. If the car is unsafe, you may have a liability issue if you fail to disclose the problem, but you can sell it.

You should always have a used car checked by your qualified mechanic before purchase. If you buy from a private individual, the sale is as-is. A dealer may or may not offer a warranty. Either way, it is worth the expense of having the pre purchase inspection done!

It isnt illegal, but is it right? If you know about the brakes, then out of safetys sake, please tell the buyer of what is wrong. How would you feel if you bought the car not knowing about bad brakes and then having an accident later. Someone or yourself could be hurt.

It is only illegal to sell something that is bad when you do not inform the customer.

If you have an ad that says " great car, blah blah, but it needs brakes " then you have no problems.

But list it like "great car, blah blah, new brakes". Now if you know they are not new yet you state they are....this is fraud.

And since a car is over $500 this would be felony fraud.

as long as you tell potential buyers the brakes are bad it's up to them if they want to buy it anyway. also, just to be safe you should tell them it has to be towed and not driven off your property. what they do with it after that is their problem. lots of people buy cars that don't run at all so i don't think it would be illegal as long as they're aware of the problem.

I'm sure laws vary from state to state, but I think it's OK as long as you disclose there is a problem with the brakes.

I don't know if it's illegal, but if you don't tell the buyer about the bad brakes before they buy, it's certainly dishonest.
