well its a pretty complex issue so please be patient while reading this
india(present india+pakistan) was under the british rule until 1947. in 1947 it secured independence from the british but the country was divided into two countries india and pakistan on basis of religion.
areas where muslims were in majority went to pakistan and the areas where hindus were in majority went to india. the princely states were given the option of joining any of them or remain independent if they wished to.
kashmir(on border of then india and pakistan) was a very unique state. it had a majority of muslims but the ruler was a hindu. however the ruler of kashmir decided to remain independent.
but the state of kashmir was attacked by what the ruler claimed was pakistani millitary but pakistan said that they were tribals. the ruler at this moment decided to accede to india and signed the instrument of accession thereby transferring kashmir to india(which pakistan doesnt recognises till date)
at this point the govt of india sent in its millitary and regained control of some part encroached upon by pakistani tribals(millitary). however the issue went to the UN security council and an immediate ceasefire was ordered and both the sides were told to not move from their positions till the issue is peacefully resolved. the border came to be known as Line of Control(LoC)
at that time pakistan controlled about 1/3 of kashmir and the rest was with india.
howeverlater on pakistan gave away some part of kashmir to china as gift because of its strategic importance against india.
till date the issue remains the bone of contention for the two countries.

Gawd, you guys should actually look things up if you don't know before posting them. It was 1947 (not1957). Most of the states of what was then known as British India, were allowed to vote in plebicites for incorporation into India or Pakistan. The four exceptions were Punjab and Bengal both divided down the middle because of near equal numbers of Hindus and Muslims and the princely states of Kashmir and Hyderabad, both ruled by Maharajas. They were not colonies but allies of the English and therefore the rulers of these states got to chose which nation to join.
Hyderabad was a predominently Hindu state ruled by a Muslim Maharaja. It is located dead center of India. After some not-too-subtle threats, the Muslim leader decided that the safest course of action would be to join India. In Kashmir, which was right on the frontier between the two nations, it was not so easy. It was a mostly Muslim state ruled by a Hindu Maharaja. He refused to allow a referendum and simply decided that Kashmir would join India. Of course the Muslim majority and the new state of Pakistan thought this was totally unfair and of course it was!
After nearly 6 decades, tens of thousands murdered and three wars, its time for a new plan. Probably an autonomous Kashmir under joint Indian-Pakistani protection would be the most acceptable final solution.
For those of you who just like to scream at the top of your lungs "India stole it!" or "Pakistan supports terrorists!" well thats all fine and good and probably all the negative things each side says are at least partly true. So what? How's that going to fix anything. Many like to quote Gandhi, well he also said, "an eye for an eye leaves a world full of blind men..."
So what solution could everyone learn to live with......?

India and Pakistan became independent from British rule on 14th &15th Aug 1957.Radclif who divided both countries on map did not include Kahmir as it was being ruled at that time by Maharaja Hari singh who opted to be a part of India.Jinnah wanted it as it was a state of Muslim majority.Jawaharlal Nehru promised to consider a plebiscite after conditions come back to normal from chaos.Pakistan sent army to take it by force.That army selectively raped and murdered Hindus.Jahawarlal retaliated by sending Indian army which ensured safety of civilians Hindu or Muslim..A UN mediated ceasefire stopped the war begun by Pakistan.Nehru a Kahmiri himself claimed that India is a secular country and ruled out a plebiscite.
From then to now Pakistan did not allow a single peaceful day in Kashmir.

well dude tough question
you're lucky i'm bored today
all i know ( not being super duper bright ) is that it is predominantly a land issue. kashmir beig somewhere in the middle ( why is being in the middle always so fucked up?) pakistan was a part of india until very recently, circa 1970s, when it demanded an independent state and hence receives its independence(duh) i believe by mahatma gandhi himself ( the honour!!)
the separation was caused by not so much religious issues as much as the divide and conquer policies implemented by british colonialists which segregated the hindus and muslims through economic divisions yada yada yada and they never quite made love to each other again after that . so the confusion that was seeded into their minds by thier very oppressors is still now a major factor in their yada yada yada.

after freedom of india from British, the Muslims asked for separate county to live since India almost surrounded with Hidus, no one accepted for that from congress the only big party ,but ghanthi agreed for that , even for that with the wish of whoever want to leave from India to Pakistan they can leave , if he decided to push all Muslims to pak it cloud have been great, so the big India divided by two , by the time of dividing Pakistan agreed as loc given by congress , after that they started war to Case the place from India but India has won the war with the very big help of Indian naval force and the army , from that day they have been trying to chase the places around Kashmir ,even we had a fight for Tiger hills , even NOW there is a place called POK that means pakisthan occupied Kashmir . so the mind set to occupy India , the part of Pakistan people keep on fighting to India with the name of god Allah .

Very schematically, Pakistanis are attempting to grab territory that is not theirs, under religious pretexts. Simple. In exchange, pakistan is funding trans-border terrorism and sending insurgent terrorists into the indian border.
Pakistan has a long record of financing terrorism and if the present administration, out of fear, is giving a public image of cooperation, in their deep hearts they have a flagrant hatred of western and democratic ideology.
How else can you explain that the multi billion dollar hunt for Ben Laden always has put the US in a ridiculous position? The answer is simple, as it is the Pakistanis who are tipping out Ben Laden and giving him protection.
India has long attempted to warn the international community and the US that Pakistan is a terrorist state. Stupidly, the USA has and is still ignoring the warnings, so guess that they just deserve (the US) to pay the price.

Actually, I asked this same question from a Pakistani and an Indian nationals. The Kashmir issue's about their boundaries...... as to who really owns this boundary.

It's simple. Both countries believe Kashmir belong to them. It is compounded by the religious beliefs of the two countries.

Real Estate! And Its the Govt's fighting it! All the locals on both sides are content to live in peace. On occasion the opposing armies just get riled up and start shooting.
