The case is dismissed, but it can be re -filed.
For example, you owe me $25,000, and fail to make the agreed upon monthly payments. I am unable to contact you, so I file suit against you.
When you are served with the suit, you contact me and we are able to work out the problem. I will then ask that the suit be dismissed without prejudice. This means that I am not giving up my claim to the money. I can re-file the claim, if there are further problems.

Without prejudice means that the person can bring the same issue back before the court.
With prejudice means that the same issu can not be used in court again.
