I got a ticket for doing 62 in a 45 mph zone. Yes, I did it, but the officer that stopped me was just horrible. I haven't gone to court yet, but I am going since it's my first ticket ever but wanted to know if it's something I can fight? I could tell anybody about the top of his head that should have been covered by his hat. I know that his hair is strawberry blond with a diamond shaped balding spot right in the middle and a routine buzz cut. Also, I know they have to be cautious, but that was a bit freaky when he almost pulled his gun on me when i didn't put my window down since I had just gotten them tinted the day before. Anyway, do you know if I have anything to work with before I go to court in two weeks?

no there is no rule in any state for officers to wear hats or not to wear hats to write valid tickets. wearing the hat is just something the department wants the officers to do to look professional

You were doing nearly 20 miles over the speedlimit. The fact that you were speeding and had tinted windows - how was he to know what was (or was not) in the vehicle. I know someone killed when a gun was fired from the other side of the door. You should be freaked out...and figure out from the other side what would you do? Hat or no hat, you were in the wrong and you know it. Pay the ticket. Then go thank him for giving you a ticket before your speed hits a kid running out in the street or a car over the crest of a hill or other obstacles that usually are in place in those speed zones. Would you rather live with the ticket or killing someone? He had every right to draw on you under those circumstances. Consider yourself warned and don't do it again.

oh, please! That would mean we could do anything we want and get away with it if the cops hat gets blown off?! There might be a departmental requirement that the officer be in full uniform in the performance of his duty, but to think that not having his hat on will get you out of a ticket is pretty crazy. Just go into court and be honest and respectful. I would say that you need to accept responsibility for your actions and with a mature and responsible attitude in court you might be given some slack.

No there is no law. many departments have rules that the officer should, but it does not make the fact you broke the law invalid.

And let me see, you have tinted windows and would not obey his command to roll down the window, ( you are really and I do mean really lucky you were not laying on the ground handcuffed, most of the officers I know would have considered you refusing to obey thier request and would have arrested you and impounded your car.

I would say you should thank him for being nice, since he did not do what most would have done.

Some tips for getting out of a ticket:
1.) Show up 15-30 minutes early
2.) Wear a suit
3.) Say "Sir" or "Ma'am" and be very respectful
4.) Don't make stupid excuses

I fully encourage you to go to traffic court and request a dismissal for the police officer's failure to wear a hat. Please do. When you get back from court, please re-post here and tells us what happens. We all need a good laugh now and then.

not sure about the hat thing but i would recommend hiring a traffic lawyer. there like 100 bucks. look into it
