I live in California. They're legal in most of the state, while not legal in some parts (like the foothills and forests where it's really dry). The fireworks they permit sales of are called "Safe and Sane." Somehow, people always manage to get their hands on illegal bottle rockets. Invariably, one lands on someones roof and the house burns down. It's not too happy of a 4th for that family to say the least.

Edited to say I found an example of a house fire involving those "Safe and Sane" fireworks I mentioned. A dad bought some for his kid in a neighboring town (where fireworks sales are permitted), then brought them to San Jose (where no fireworks are sold or allowed). The kid gave some to a 6 and 9 year old. The 6 and 9 year old caused $300,000 in fire damage to a home where the owners were on vacation. Here's the link:

I can't think of things (off the top of my head) that would be sold, but illegal to have. Can you give some examples?

If they are being sold in grocery stores or stores like Wal-Mart, than they are not illegal.

In some states, certain types of fireworks are illegal. But, I don't think that any state has totally outlawed them. That would cause a massive public uproar.

People like the visual effects of fireworks. They do not take into account the possible harm they can cause to themselves. Also it is the thrill of breaking laws without getting caught that causes people to do it. If an area is in a drought, fireworks should be banned.

I live in Wisconsin and they aren't illegal here. As for why people sell illegal things - because they are worth a great deal to people who want what they can't have.

They are not illegal in every state.

If things are illegal but sold anyway, they are probably things that are cool to have... like fireworks, guns, etc.

Coolest job: Dept of ATF.... all my favorite things in one law enforcement agency. I'd be raiding the evidence cabinet constantly.

Fireworks illegal? It depends on the place you live in and the codes they have.
