If she had no insurance she most likely couldn't afford it, so suing will get you no where. Your insurance agent should be able to help you with all you have to do. In the mean time your insurance will have to pay for it. They may even get you a rental.

Contact your insurance company and let them handle everything. Gather as much information on the person that hit you and provide that to the insurance carrier. Expect to pay a deductible. If your insurance company recovers any money from the person that hit your car, they will reimburse your deductible. If you are hurt AND you have uninsured motorist coverage (including UM bodily injury coverage, then your insurance company can pay your medical bills, and pay for your vehicle)
Tell your insurance company that you need a rental vehicle, and depending on what type of coverage you have, they may be able to provide one, however, many rental companies don't rent to people under 21. You might have to borrow a parents vehicle while they drive the rental vehicle.

Ugh, i'm guessing he wouldn't have coverage and also you've gotten to pay the deductible (or each and every thing! in case you do not have coverage adverse to uninsured drivers). If he does have coverage, the police will probable get it out of him. And yeah your coverage company would sue him, yet when he wouldn't have the money that's noticeably meaningless. I were given hit by utilizing an uninsured motive force over 10 years in the past and nonetheless have not been reimbursed because the different social gathering under no circumstances paid up.

If you haven't filed a police report, you need to right away. Then call and report this to your insurance agent. You willl get a claim # and an adjuster. If you have "uninsured motorist coverage" then your policy will pay out. You should report it either way b/c your insurance company has lawyers which is part of your policy. I wouldn't call your own lawyer unless your ins. co. can't help you.
Good Luck!

If it were me:
I would push the insurance to finish my claim so I could get another car. Then, sue the individual for the difference between what the insurance gave me and what the cost to replace my car was.
In addition, I would go to every single court date the person who hit me had and speak up to make sure they were punished appropriately.
I hope you weren't injured.
Good Luck

Make sure you have a police report and get a copy.
Contact your insurance and begin the claim process.
Your claims adjuster will then go over with you of your options.
In Ca you need to notify the DMV of he accident with in 10 days.
your insurance will try to go after her for reimbursement. you my sue he to and try to get the difference your policy did not cover and any other related expenses.
If she has a job garnishment of wages. If not it will mess with her credit and follow her for long time.

Get a lawyer ASAP and talk to him about your options. In the mean time, might as well start car shopping.
