The best way to find out is to ask a cop if your state has a two party consent law. Maine, for example is a single consent state, which means that at least one participant of a phone call has to have knowledge of a recording. You might find the title under a statute called wire taps or electronic recorders

As far as I know, yes. As long as one person in a conversation of two people know that it is being recorded it is legal. If its 3 or more people all parties must know for it to be legal.

Not sure, My landlord got really huffy with me when I said I had a recording on him (on my answering machine!) He assumed I was recording him and started yelling that it was illegal. Not sure. You could do it but when it comes to using it against someone than you have to find out the law.
