As long as you have the time already accrued they should have to pay you, unless there is some rule about only being able to use so many days/month and you've used it or something or if you are a new employee and aren't past your probabtionary period. Some employers will not let you use vacation time to cover sick time either. Check your employee handbook. If you are within your rights, contact your state labor board.

No. If you have the time accrued or earned they cannot refuse to pay you for it. If you have a doctors excuse it would be considered sick time. When you run out of sick time then they are allowed to go into your vacation time.

Yes, if you did not follow their procedure in calling out sick (for example, if you are told you must call two hours in advance of your scheduled start time when you know you are sick and you only call one hour in advance) then they can claim that you did not follow their policy on the use of sick time. Note: If your company uses both vacation and sick time, they do not have to pay you vacation hours when you are sick at all unless their policy allows you to use vacation hours.

some employers require vacation time to be scheduled in advance and be approved. sick time on the other hand is different. If you followed the company policy about calling in sick, you should complain to HR. If there is no HR in you company, contact the state labor board.

If you aren't eligible to receive vacation and or sick time than no, they do not have to pay you. Vacation and sick time are accrued and sounds as though you haven't been there long enough. Company's aren't obligated to pay you for time not worked, especially if you are paid on an hourly basis.

They don't have to pay you anything at all unless you are there.Sick time and vacation are up to the employer,if he chooses to provide these benefits.I have a very good employer with very good benefits,but we have no sick time pay.It's a trade off.

Per U.S. Department of Labor standards:
Your employer MUST follow their own written/established policies related to use of paid-time-off. Look at the companies' Policy & Procedure Manuel. Then insist that it be followed....

If you belong to a union stop your crying and let them figure it out but if you don't read the company's handbook on the do's and don'ts and if push comes to shove get a lawyer for your troubles and if you should win have the company pay your lawyer fees.
