It is illegal in most states to record a phone conversation without the other parties consent whether you are a participant in the conversation or not, honey. I would just walk away from the situation, and it is inadmissible in court.

Most states you can't record a conversation unless you make all parties involved aware that you are recording. Being a party to the conversation doesn't matter. Now if you're recording it for your own purposes, not for any legal purposes, I don't suppose it would matter. And since adultery doesn't mean squat in court anymore, there would be no reason to have to use the recording except to find out whether they are cheating or not.

If the telephone line is in your name you have every right to record...if not well then you can never use/share the recordings with anyone else. But as an FYI: If you listen to your instincts, you already know if he's cheating...why risk legal problems

probably not a good idea but there has to be other clues to go with then the phone. Hes not home as his usual times, he talks about someone alot, there is usually day to day things that make you have doubts and if he is he won't stop he will do it again and again. My X cheated on me and I knew it and he did it again so depends on if you want to put up with it or not but first make sure you have proof before you accuse him.

If you know he is already cheating why are you going through all this for? It can not be used in court so why bother. Who will you try to prove it to yourself? Give up the idea of proving it and show him you won't tolerate being cheated on.

it is illegal to record someones call without their consent.
that means in practice that you can record it to confirm your suspicions but must destroy the recording immediately and hope your spouse never finds out what you did.
obviously, you can't rely on it in court and would be committing perjury to deny it.
so be very careful.
eavesdropping would better suit your purpose.
