This not necesssarily trying to pursue satuatory rape the two are just in highschool and are sweethearts the male is just older than the female but they are planning on be together for awhile and he also wants to marry her in the future.

Statutory rape. YES - Though I doubt you'll actually see jail time. You might be considered a sex offender btw.

Even if the girl won't push charges, the parents or District Attourney can.

The fact that you are going to be with her for 'awhile' is completely irrelevant.

The massive confusion caused by the various but very different sexual crime laws (which often have legal terms which are not interchangeable or parallel from jurisdiction to jurisdiction) usually leads people to assume that any violation of the age of consent is a "statutory rape" crime.

Laws vary widely in their definitions of statutory rape; some states make exceptions when the older person is also young or of a similar age, or if he or she marries the minor before the act of sexual intercourse or before being charged with the offense. Due to a wide variety of opinions on what the proper age of consent should be, and conflicts between child sex protection laws and the natural exploration of teenage sexuality, statutory rape charges can sometimes be controversial and contradictory.

Some critics contest the legal characterization of unlawful, non-forced sexual contact as "rape" or "sexual assault." In addition to being seen as an incorrect use of those terms, critics believe the absence of a distinction diminishes the severity of actual (forceful) rape. Furthermore, they argue that charges and punishments should reflect the presence of force, so as not to suggest that actual rape is no worse than, for example, non-forced sexual contact with an adolescent.

I would think the only way he would go to jail was if he was charged under the statetory rape law, however it sounds like they were both concenting youths , who did not have the maturity to look beyond at the reat of there life, so as a young mom once I would hope that both the girl and guy's families come together as a unitied front of support for these kids as well as foe the unborn grandchild on the way. I applaud the boy as he is showing great strength in standing beside hie girl, and that says alot about his character. Why would you ever want to jail someone like this.........when there are so many dead beat dads and low lifes out there doing way more damage and harm to a women and walking away!!!! This sounds like a responsible boy!!!!!!!

It really doesn't matter...it is still statutory rape. He will have to have the girl's parent's permission to marry her, that may satisfy the law. Otherwise, it may land him in jail.

yes, he can go to jail, and yes he would be charged with statuatory rape, depending upon the laws of the state that both parties live in, most states, the law of legal age of consent is 18, some states, have that law age as low as 12, so more than likely the state you live in the age of consent is 18 and yes they guy will go to jail, and be charged with statuatory rape due to the fact the female is only 16

The 18 year old is considered an adult, and having sex with a monor is STATUTORY RAPE in all the states I know about. Yes, he can go to jail for a long time for a few minutes of sex. Very stupid thing to do.

short answer is yes, the law states that anyone can impose statitory rape charges, even if they are not a member of the family. the likelihood of this happening is slim, but the answer according to law is yes. when I was in highschool I was dating a girl a year younger and I asked the police about this and that was the answer I got.

YES! If she reports him to the authorities, or her parents could do the same thing. The likelyhood of u being totally screwed is pretty high right now. So say a prayer that she likes or loves u too much to tell anyone, and that her parents won't turn u in.

Not only could that 18 year old go to jail but he could also be labeled as a sexual predator. Once one is labeled as a sexual predator, his movement will be monitored for the rest of his life. He will never be allow to work anywhere where their is children, his neighbors will be notified that there is a predator in the neighborhood, and you won't be able to live anywhere where children congregate (schools, play grounds, bus stops, etc.)

This label is very detrimental and it does not go away.

Depends on the state they live in.

Some states have laws and it depends on the age of the male.. there is sometimes a year or two lee-way on the statutory rape laws.

In Canada no: the legal age for a minor to consent to sex is 14 soon to be 16 unless it is proven that it was rape, in US I don't know
