Ok, I am reposting this question due to it's extreme importance and time constraints. I have added more details and answers to the questions you have all asked. Please review my last two postings to get it all and feel free to look at others answers, but remember, what I REALLY need is good legal advice from someone who has a background in this area. I know alot, but I don't know the in's and out's of how the case would be tried. Please read the details if you want to help this dog out and get him back home to me where he will be taken care of and back with his buddies. Thanks...

Small claims court isn't an option, that is only for money disputes, not propery, I checked. The dog was neutered, against my will, and so breeding isn't an issue. Yes, this is both me loving the dog, and "misdirected grief" as you might say. Actually I can't stand her now, and paybacks a ***** as they say. Nevertheless, he is better off with me. I can afford him and a nice place for him, plus his buddy is with me. She is just a drunk, druggy ***** who has gotten everything she ever wanted.

Alright, I asked for the low lifes on here not to waste my time, SO, "babyitsyou", you ignorant *****, I explained why I waited this long, I had to, what the hell are the police going to do, tell me to go to court dumbass. SOOO, thanks for wasting my time with your ignorance. I don't need counseling just because I want my dog back, so **** off. To the other QUALIFIED answer on here, I don't want the other dog back, I already have two, and I never wanted this other dog in the first place. I bought this dog for her for Christmas and then she left. I never wanted it and still don't, it's a headcase just like her and this other idiot giving me this worthless answers on here. Why do ignorant people answer questions like this when they know they aren't qualified to even mop a floor?? I tried to specify this is important, oh yeah, I work 70 hours a week too, to support me and my dogs, so maybe that could be a reason it has taken a while on top of the legal issues involved. GET a life.

have you tried just calling an attorney's office, asking to speak with one of the attorneys briefly about a property issue... i have done this many times in the past about this or that and they have always come to the phone and are willing to listen and give me some information... just express to the receptionist that you have a quick question to ask an attorney...

you must have been ga ga over this girl.... is it really your attraction to the dog or your loss of the girl and misdirected grief...

you want this dog back and i wish you the best...its a sorry situation but i agree with others, take care of this sooner than later and speak with an attorney... you sound intelligent and i think you are afraid that you may hear that you dont have a leg to stand on...i think you do tho myself...you bought the dog... you dont need an attorney in small claims court (you didnt mention the actual price paid for this dog)...

there are other issues that come to my mind...breeding of this animal means income to the owner...

if she says the puppy was a gift and you deny it then it is word against word...that is where character comes into it...

if you dont go to court you will never know... so you must!! but call an attorneys office first, more than one of them if you want, and find your comfort zone....

then go to court willing to accept the judges decision.... but give it your best and be yourself and relax....

ok then, my suggestion then again is to call various attorney's and get a feel for different answers that you are given...

if you are financially secure and able to take her to court if you feel your battle may be won, then i say do it ... you will regret it if you dont... but also, it is kinda like a divorce...no one wants to have to foot the bill but you have to so you just do it ...

so...the first step is to call around and get some real answers about the law... you know what she is going to say so that is what you must ask--if she suggests that it was a gift does that win it for her... and being that it is a dog and not a child, can the better living condition and more stability win it for you... and the fact remains that both names are on the paperwork and she took the dog, neutered the full-breed without your consent, and you were under the assumption that she was returning with the dog but didnt but in fact neutered the dog instead...

(what about the other pet she took, i havent heard you say much at all about that dog which makes me think that most of this is about your loss of the woman, although now it is probably misdirected anger rather than the feelings of loss for the wench)

and of course, ask the attorney, is it true that possession is 99.9% of the law...how much does that matter in this case....

i just had an idea come to mind... maybe see if you can contact PETA about this... they may know something about the law that an attorney may not care as much to determine without you paying a hefty bill....

He's lived with her 6 months. You never called the cops or complained until now.

You bought it around her birthday. She has custody at this time.

She will get the dog. It IS a dog, not a child. The court might even get a little mad at you for wasting everyone's time while trying to get back at her for breaking your heart.

You've been going on and on about what a spoiled, druggy, drunk whatever she is. You've gotten all the answers people here can provide.

Hire a lawyer.
