As other people have said, it varies from state to state. However, I don't know how strictly such a law would be enforced. The only real danger I can think of is that it may cause you to not hear things like horns in the background.

It's illegal in most states. That said, some states are starting to pass laws requiring hands-free devices with cell phones. Sounds like a defense to me!

Depends on the state- I live in Idaho, and here, talking on a cell phone (even hands-free) is enough of a distraction to be illegal.... equivalent to being drunk
I used to live in Utah, and there, driving sleepy is equated with driving drunk...
