I can't afford to pay for a divorce and my husband won't keep a job long enough. He doesn't want to pay child support. He's living with another woman and she doesn't know we are not divorced. I told him that I would tell her, but he still refuses to cooperate. The state has a summons to set child support, but he keeps running from that, too. What should I do?

He agrees to the divorce, but he doesn't want to provide information on where he works and how much money he makes. I did hire a lawyer, but he wants that information up front for it to be a non contested divorce. I did go to the human services in the county, but the he keeps giving the child support division the run around about where he lives and where he works.

I'm very sorry about your situation. I am personally going through something similiar, but not quite the same. I wanted a separation, which he refused to leave our two children. It took a long time, but finally I got my spine lined up and took a stand (domestic violence situation - mostly verbal/emotional), so he did leave, and he took my children. He and the children (6-boy and 3-girl) are living with his parents because he can't afford anything else. THAT in a nutshell is why he took the kids, he doesn't want to pay child support. As for the state summons regarding your husband, each state is different. I live in NY, here we have legal aide, call around, YMCA, social services, research the internet. Definitely get down to or at least call your county's social services department. They don't play around. There is an answer out there. These days it is rare for a man to be able to get out of paying child support, unless the woman agrees to it. Hang in there. Pray. Try to think of the positives, the chidlren and you have food, clothes, shelter, and most importantly, health. As for the other woman, personally at this point in time, I'd leave that alone. Good luck! :)

tough situation. divorce is not that expensive if you know how to file the paperwork (under $250 in most states if you are in the US). You are not required to have a lawyer and it would come out of the pre-marital 'estate' if you had to get one. Go to the local family court and start asking questions. he has NO option on paying child support legally, but he can avoid sending checks and risk jail time. if you cannot make it financially, talk to the court as well and they can point you to some government assitance. good luck.

Regardless of whether or not he wants to pay child support he has too. Unless he signs over his rights he is obligated to pay child support regardless of whether or not he wants too. If he doesn't pay his child support he will end up in jail.

Contact a lawyer and have them help you with options. Or you can talk to a case worker in the Jobs and Family services in your county and ask them what you can do. Either one should be able to help you in the right direction.

That's tough. For one thing, resolve to NEVER get involved with deadbeats!! Second, ask a law firm for "pro bono" help. You need a judge to tell him how much child support he'll pay. The system ain't good but it's better than it was in terms of keeping track of him and squeezing him for the support.

Don't sign any divorce papers until he comes to an agreement about child support. Hate to give solicitors money, but think you will need one in this case as your husband sounds unreasonable.

Leave it up to the law. Make sure you keep bugging the Law. The more you bugg them the more they will do something about catching him. And once they do catch him. He dont have a choice to pay child support. Good luck. My kids father is over 7000 behind in Court Order Child support. But I wish you the best!

YOU CAN ALSO GO TO YOUR LOCAL COUNTY COURT HOUSE AND INQUIRE ABOUT HOW YOU SHOULD GO ABOUT ALL THIS.
