I allowed a friend to move in almost a month ago because she had no place to stay after her boyfriend beat her up. Subsequently, I have found that she cannot work and I end up paying for everything. I cannot continue to support two people on my one salary. I would like to have her move out but she has no where else to stay. Am I legally allowed to have her removed? How would I go about doing so? And if she refuses to leave?

This is in Texas.

Start by standing up for yourself.
If this is your apartment and not the other person's then tell them they need to leave.

Prepare for sob stories as to why they can't move and have to mooch.

Remember you're not really helping her get better and independent. If her boyfriend beat her, then she was probably co-dependent. Now she is co-dependent with you. Believe me people are incredibly resourceful and self-reliant when they have to be. But as long as she figures she has you for a sucker, then she doesn't have to be any of those things.

If they are also on the apartment lease, then you will have to get a lawyer involved to see what your options are.

Tell her nicely that she's either going to have to start paying rent or move out.

If this doesn't work, send her a letter telling her that she has 30 days to to move out or you will commence eviciton proceedings. If she fails to do so, then you'll have to file eviction proceedings in court to have her removed. Although you can do this yourself (file the case, NOT evict her without the courts!), you should seek legal advice from an attorney first.

If you decide to go it yourself, go to the courthouse and speak with the clerk of court. They can advise you on what you need to do.

If she is living in YOUR personal apartment, her status MIGHT be that of a house guest. If she refuses to leave, she MIGHT be a trespasser and the police MIGHT be able to remove her. Check with the police on this; they will know if they can do anything for you.

If this really is a friend, you migh want to research what social services are available for her such as shelters and job training and help her to get back on her feet.

If you are the landlord give the tenant a 30 day notice. If you are not the landlord file a complaint with the management and make the problem known. Be very persistent .

try to encourage her to go to a domestic shelter they will give her the resources she needs to get on her own two feet if that doesnt work depending on the state in which you live you can legally remove her you must go to your local court house explaine the situation and they will provide you with the necassary papers also try encouraging her to check other resources such as social services or charities in your area

Your apartment, your rules. Assuming that she is not on any contracts, either with you or the landlord, you can simply kick her out. Call the police if you need to. They have women's shelters and help for women for domestic abuse. Plus, you don't want to involve yourself in this mess and become a victim yourself.

Tell them that they are not on the lease, and that you got a notice from management for your immediate eviction if they do not leave!

you can either do it legally : with a court order/eviction notice or get some BIG friends to help you ask them to leave....
