I did give 3 day notice to tenant to cure violation or move out.
New month starting, three days passed, tenant did not moved out.
Should I take payment for new month.

NO, never take payment during the process... the court will throw your case out so fast it will make your head spin. If the check is in your office mail it back certified so you have proof. wait for the eviction process to go through.

i don't know what state you're in, but here in SC, if the eviction process is started, and the tenant pays you ANY amount of money (whether it be $1 or ALL back money owed) and you accept this, then it stops the eviction process, and you must start all over again. many renters know this, and will try to get you to take cash from them, so that they can buy more time without paying you rent owed.

DON'T ACCEPT IT IF THEY'RE CHRONICALLY LATE RENT PAYERS!!! If you do, chances are they just get to stay longer, and you have to start over.

Do you want them out? If not, take the money (but only if they pay in full all money owed to you) and let them stay. Once you take the money, you are obligated to let them stay.

If you want them to go, don't take the money from them. If they don't leave at the end of the 3 day notice, go to court and file for a legal eviction and get a court date.

no do not take money if you ant them out. Follow the laws of you state if you do not want them to stay or give them one more chance if you are kind hearted and they deserve it.
