If your exroommate moved out of your apartment on the same day that you did and the apartment is in your name ... ya'll had a verbal agreement that ya'll would split all the bills... when ya'll move out and you receive the bills... and you ask for the money from her .. she says she doesn't have it and it was 2 months ago ... would you take her to small claims court??? The amout is $182 dollars.

It is going to costs$64 dollars to take her to court but I can ask the judge to make her pay me back. And no I NEVER plan on talking to her again

Ok let me add in .. SHE IS NOT DENYING THE FEES ... she agrees that she owes what I am claiming. She just is making excuses as to why she should NOT have to pay them.

Yes, small claims court is your best way of collecting the money owed to you. It might be hard to prove due to the fact that you have a VERBAL and not a Written agreement.
I would try it anyway, though.. often a judge can determine if a person is lying and award you damages. Ask only for the amount owned to you and the cost of courts. Remember next time to get agreements in writing, it wil save you a lot of trouble!
In this case, you have the burden of proof, so be sure to have copies of all the bills owned whether they have been paid or not.. and also copies of any checks, receipts, etc.. Good Luck.
Phone bills often have dates and times that may help you prove your case. Go get copies if you have thrown them away!

If you go to small claims court be prepared. Have all of the bills in hand to show the judge. Unless she has some kind of proof that she did pay you already, then you would probably win.

By the way, don't forget to sue for filing fees and court costs in addition to what she owes you already.

How long did you live together? If you can prove that you split the bills in the past, like if you had a check from her or something that said "pg&e" because you were still living together 2 months ago, right?? I would take her to court, definately. Plus if she sees that you are serious enough about it to follow through she'll probably just pay you.

This has me scared because it is exactly what I am doing with my roommate. Maybe I should get it in writing...because everything is in my name and she just pays me half of everything....thanks a lot they say you can learn from your mistakes but sometimes it is nice to learn from someone elses.

you might want to and yes you can ask the judge to add the 64 to the amount you want back but do you really want to make that big of a deal out of it. i dont think i would go to court because you are going to miss work so that is a day of pay, you really have to look at everything you would have to pay or lose to get the money back and if it is worth it to you go for it

Not worth your troubles.
Take time off from work. Added stress in court. Same situation in worse case scenario if you lose, but with the added court cost.
No coffee for two months is about $182.

If I had the money, and it wasn't a hardship for me, I'd go and pay it and forget court. That can REALLY kick up some dust!!! Just call it a day with her, and get on with your life. Ya'll have a good one, hear?

If you have the time go right ahead and take her to court. And dont worry about you fees if you win she will have to pay the amount she owes you PLUS court costs.

You can take her to court, but it's a lot of hassle. Live and Learn, as they say. Next time, get a written contract. Maybe you can go on Judge Joe Brown or something.

Small claims court will cost you your time. You will spending and wasting your summer mornings in court. Its only $182.00 and if shes was a real friend she would have offered to pay you half, otherwise it doesnt seem like she worth the trouble. who needs a friend like that!

Sure, make sure you ask for the filing fee and the court costs and have all the paperwork to prove that the ex roomie stiffed you.
