Arrested for fleeing and eluding police. When handcuff the cuffs cut off circulation to my hands. I complained and the other officer said they could not go any loser. I was put in back of a car for 45 min with no cracked windows during the hot afternoon. While in transport to county jail the officer was doing 80-85 in a 45 were people had been killed at this intersection. Was harrased at the police station by other officers as in "That will teach you not to run from the police" when in fact was only 1/10 of a mile. Not running just went around the curve to a safe spot to pull over. What is the law on fleeing anyway, how far is it?

Better details: Police were called out for a four wheeler running through fields and tearing them up. Was not me!!! The officer claimed he chased me for 1.5 mile. Not true 3/10 of a mile at the most. But only went 1/10 of a mile to get around curve after seening police about to run us over. Had witness arrested with me to also notice he was exceeding speed limit. The claimed big chase was on camera. Would love to see that 1/10 of mile chase!!! Thanks for all your comments. But just to let you know. I do not just stand down and let someone walk all over me! Yes I was guilty of riding a 4 wheeler on a dirt road with no helmet. So where 20 others passing by while i was arrested. They did not stop them! They also took my cash i had in my wallet which was my gas money to get to work for the week and said it would be mailed out on May 9,2006. Check was dated May 17,2006. I missed a day of work because i had to get a loan for gas. Hmmmm figure that.

You would have to present evidence that you were detained without probable cause in order to have a case. You don't need to prove beyond reasonable doubt, just a preponderence of the evidence as this is a civil matter. It's hard to tell precisely if you would have a case based on your details, but I would guess that you have an uphill climb if it boils down to your word versus theirs. It might be advisable to consult a lawyer about this, but only if you truly feel that this was a case of police abuse of power.

fleeing has not direct distance, if you give the impression you are not stoping, ( did you slow down, did you motion you were stoping) and so on.
Next what was the stop about in the first place, since they did not stop you for fleeing. That also has some bearing on it.
Ok, Cuffs are tight and hurt like ...... So unless there was actual damage done to your hands and wrist that can be determined by a doctor there is no case there.
note... cuffs are double locked once they are put on, so they can not get any tighter. Also very few police officers carry more than one size of cuffs, so anyone with larger wrists will have alot more disconfort than someone with smaller wrist.
Offers telling this will teach you, is not harrassment, you may not like it is them making fun of you for your actions, if that is all they said without any cuss words, it was a tame time being arrested. Normally there will be alot of commenets about or to you during an arrest.
Officer speeding, get over it, officers seldon get into wrecks, are trained in high speed driving and driving courses of all sorts, Plus he would deny it, say it was just you complaining and his word against yours, no one will beleive you, and you can't prove it.
So in the end most likely you were arrested for the orginal charge and will also be charged with the fleeing.

Why not just accept responsibility for what you did, chalk it up to a lesson learned and move on. You were obviously breaking the law in order to get pulled over in the first place.
And you know what, my house was searched last year without a warrant, while my 15 yr old daughter was home alone, standing half naked in a robe. The person they were looking for didn't even live here and never had. And because my daughter was unable to "show her papers" proving who she was, she was threatened with being taken downtown, finger printed and held until I picked her up. I didn't sue and by God I could have. Instead I chewed some cops out and let them know they just ruined everything I'd ever taught my daughter about giving them respect.
Get over it, pay your fine or whatever and quit whining.

Have your day in court. Tell it to the judge. See what happens. Sounds like you are in a small town. (County Police) If so - if you are physically fine, I would keep my mouth shut. Cops have a way of "getting back" at you.
If you are injured, then - if the judge kicks it - sue if you want. Really think this one over!

Yes you can sue. Check the yellow pages for an atorney who specializes in torts. S/he will probably give you a free 1/2 hour consultation.
