No, there is NO excuse for an employer to not make it his business to know if the people he hires are legal or not. They should have to take a photocopy of the prospective employee's documentation - green card or SIN and there should be a check made with the authorities prior to hiring. If they hire, truly believing the employee's information is legal, after going through the proper checks, then the employee should be seized by the INS, charged with the criminal offense of fraud, and deported immediately. If the employer did all the required checks, then he should be okay, even if it turns out that the employee provided fake ID that somehow checked out as legal. But, the employer should have to show proof of all the checks he did, including photocopies of the documentation the employee provided. If he cannot provide this, then the employer needs to be charged and prosecuted to the full extent of the law. Repeat offender employers should be fined and charged in a dramatically escalating manner. If this happened often enough, employers would stop hiring illegals and illegals would leave the country on their own accord and at no cost to the US taxpayers.

Well working in construction I know a little about this topic.

We hired some illegal workers once and almost lost our contract. We were on a Gov facility and the papers looked fine to us until they had to get a pass to get on the military base. When they entered Pass & ID the papers were marked as fake these guys were handcuffed and sent away. Well when they got through with us we knew how to spot the fake documentation and got good at it. Ignorance of the law wont fly in court. So find the books that show you how to sot the fake. Don't become a victom of the invasion. The esiest way to spot an illegal is to talk to him he should be able to say The Pledge of Allegiance. Well maybe not if the ACLU has its way our own children wont know that one any more.

How is it possible not to know. If you hire someone you must take their social security number in order to file tax. If you are hiring someone to babysit or do work around your home, then, you must also take their social security number as well and do a background check. This will only be beneficiary to you and your family. Also, not all people who are undocumented will harm you or your family, so just keep that in mind and stay within the law. Don't let being lazy teach you a hard lesson.

It happens, but the majority of the time the boss does know. In fact since there are few new (fake) greencards being made, most ilegal workers use the old style. If the boss really wanted to know, they could just run their SSN! They dont, and I dont blame them, a good worker is a good worker. At least some people are sympathetic!

Your obligation is to ask for documentation. You're asking a question similar to is it ok to take that bag of money you see by the entry to the bank because there isn't a name on the bag.

Good luck my friend, but illegal in my opinion and hope you get caught if you do it.

Paying them without a social insurance number or in the states a social security number? Seems to happen a lot. These big meat packing places do it all the time.

"Undocumented worker" is a politically correct term for the criminals that are here illegally and breaking additional laws by being here and don't care what they do as long as it is for themselves. I will bit use their BS term to sugarcoat the criminals they really are. They are breaking the law by being here and are criminals and threats to national security

DEPORT ILLEGAL ALIENS

If by OK do you mean legal, basically no. That would be like saying, is it OK to run a red light if you did not know it meant to stop.
