Okay, the other day i got pulled over. The state tropper ask for resgration, insurance and id. I couldnt find any of thoes, so he told me to hand him my keys. Keep in mind all of my windows were rolled up except my driver and my window are power. I live on the beach and it is a bout 90 degrees. I told him i couldnt becasue i had a ten month old in the car and it would get to hot for her. But he still made me give him my keys. He took about five min. And i found my resgraiton. He told me to step out of the car, i reminded him that i had a ten month old in the car he said we will just be in the back of the car. He gave me three tickets, and a warning on my glass window. The three tickets were driving with out proof of resgriation, id, and insurance. He gave me my keys back and i was on my way. My question is was it legal for him to leave my baby in the car with out any circalation or ac for my baby, and was it right to make me get out of the car and leave her in there?

I cant state whether or not it was a legal issue. I am not an attorney. However, you have the right to complain. The trooper that gave you the ticket will have his name printed on it. Contact your state trooper's office and inquire how to file a grievance. I can't understand however, how you could drive around without the most important papers not in your vehicle. You must understand that some of the responsibility for your bad day lies with you as well.

Well to start, I love some of the stupid answers you received here. Everyone seems to know that very cop is wrong all the time. first of all, the officer has the RIGHT to put you where ever is reasonable for his safety and yours. He does have the right to get you out of the car. and since you and the officer were only about 5 feet from your child at the back of the vehicle I see that there was little if any risk to your child. However if you feel your child was put in jeopardy then complain to the Police Department. The officer was doing his job properly and you had to deal with it. Just think, if there were not so many jerks out there like the some of the others that answered your question, there would be less need for so any officers.

Since there were no lasting effects on your child then there is nothing legally speaking that you can do. But if you really want to make a difference and stop this from happening again to you or someone else then speak up. Do as adjoadjo stated also contact the local papers and radio stations and city councilmen and mayor. Or anyone that will listen and try to get a law passed that may allow for the child to be taken out of the car or atleast have a door opened or window. But I agree that you have responsiblity in this to. It is your responsibility to have your papers in order in case of this situation. If you would have then you would have gotten out of there cheaper and faster without all the hassle. But yes ethically it was wrong so change it. Do something about it!!

It was not illegal. Was the baby hurt by this action? It would be safer for the baby to remain in the car and secured in the car seat than to pull the baby out of the car. It is also safer for the officer to remove you from the vehicle than to stand at drivers door closer to the traffic. Assuming, you pulled to the shoulder of the road. Also, safer for the officer so that he can see you if he went back to his vehicle. Why did he give you a ticket for no registration if you found it?

~Lesson learned: It's a bytch to break the law when you've got your kids with you. He could have impounded the car and made you walk. Guess it pays to carry the documentation with you that the law requires you to carry, doesn't it.

it was not right for the officer to make you get out of the car with no circulation for the baby. but the courts will proably say it was legal since the officer was following police policy on pulling over people

your best bet is to contact not inly his supervisor but internal affairs to file a complaint for putting your baby in jeopordy. as extreme heat can put a car at lethal temps in minutes. you hear about cases on the news of that with animals and children. as far as the tickets, if you couldn't find them right away, once you go to court to show you have them. everything is dropped. if you found your registration as you stated and he still wrote a ticket for not having it, it would be thrown out, but report that to his supervisor also.

it was wrong for him to leave the baby that way. It was probably not illegal, unless you can prove to a court of law that it was actually endangering the child.

no he was wrong and you better get a lawyer cops will never make you get out of the car unless they suspect you drinking or on drugs. get a lawyer and report him asap
