I know who my baby's dad is, but I was still legally married when I got pregnant , so the court assumes that my (legal)husband is the dad. I have been dating one person since me and my ex split up, and I haven't had sex with anyone else. (I just wanted to clear that up). I have two children from the marriage already, and my ex has not had to pay me child support. In order for child support to go into effect, my divorce has to be final. My court hearing has been set back several times for different reasons. So, I thought that if I could get a paternity test now, I could try to get my divorce final before the baby gets here so it won't have his last name, and so maybe the court will reconsider waiting until after the baby is born to take a paternity test. If anyone knows if this is possible, please let me know. Thanks!

You can get a paternity test while you are pregnant....the baby can be given any last name that you want it to have so dont worry about that...I dont know what state you are in but, believe it or not, adultery is a felony in the state of new York so depending upon what state you are in I wouldnt really want to involve the courts..I dont mean that you are cheating or that you cheated or anything..but technically you are still married...Dont give your soon to be ex any further ammo....

You will need a DNA smaple from your baby as well as the father...you will have to wait until the baby is born. there may be a way to test the baby in vetro but something like that would be a rare costly procedure and sticking the baby with a needle is an added risk.
Im surprised that you think yo have to give your baby your ex's last name (being that you have 2 other children) You are the one who will get the birth certificate in the hospital. You can fill it out alone or you can fill it out with the baby's Dad. Also after you deliver the baby they can give you a form called "Paternity Acknowledgement" When your new man signs it, it serves as legal proof that you both swear the baby is his...it holds up in court.

You can get paternity testing done in utero via amniocentesis or CVS. Both tests are usually only done when there is a high risk of birth defects and both pose a risk to the fetus. If you have the baby's best interests at heart and you are not being scheduled for either of those tests for medical reasons, you'd probably want to wait until after the baby is born and DNA testing poses no risk to him/her.

You do not have to give the baby his last name just because you are not legally divorced. You can put your b/f's name on the birth certificate. There is a risk of fetal death in trying to get a DNA test done in-utero. Just explain to the court that you KNOW that he is not the father and that you will not risk your baby's life by having a DNA test done before it is born.

If I am not mistaken, they need blood or saliva from the baby to do a dna test. They can't get it from the baby until it is born without it being a huge risk to the baby and mom.
As for the name. . . I know that in WI you don't have to put any name on at the time of birth, but you just have to complete a form (the hospital has them) and mail it in - they will then put the proper name on the certificate.

yes you can get a paternity test while pregnant, but it can be risky. I believe the procedure is an amniocentesis, but double check that. Many women have had this procedure without anything bad happening, but it's up to you if you want to go through with it. Even if the risk is small that something could happen to the baby, it's still a risk.

No. It would harm the fetus. the make you wait until the baby is born you can have it done the day the baby is born. After the divorce is final you can also change the babies last name after the fact. Besides you are the one who chooses what goes on the birth certificate .

That is up to your Ob-Gyn it can be performed the same way the would do a AMINO SYNTHESIS but it has risks and some women end up going into labor. I don't think they would do it unless they were going to do the amino because of fear of birth defects. It is always better to wait till after the baby is born and they do it at 6mo I believe in the state I am in. I wish you the best.

Wait until after the baby is born. I think they can test but it is safer to wait! Just dont have ANY man sign the birth certificate. Wait until the DNA test proves who is the father.

i know that you can find out paternity before the baby is born by having an amniocentesis... as far as the last name call medical records at the hospital and tell them the situation and put the biological father on the birth cert. and he signs it and proof of paternity will the baby be allowed his last name???
