About a year ago, I met and fell in love with a man. He put on a pretty good front. After I got pregnant, we married and he began to change. Two months before I gave birth, we broke up and he went back to his father's house - I found out later that his ex-girlfriend was living there with them. He lied and made a fool of me. He told me that he wasn't going to pay me a dime in childsupport and he wanted nothing to do with me or my baby. With that in mind, I too wanted nothing to do with him. As per his wishes, my daughter was born w/o her father. On her birth certificate, under father - it is blank. Her last name is the same as mine. The only tie that holds me and my ex together is that we are married. Does he still have rights to her? Can he one day say I want to take her away and visit with her? When we go to court, does the child suport come into play since we are married? Can't we skip all of that and pretend we never had a child if agreed with my husband?

Leagally, he has rights to see her. To take her from you, he has to prove you to be unfit. That can be hard to do. He will have to pay child support do to the fact that he is, by all rights, her father. They could issue a paternity test since he name is not on the birth cirtificate but what I would do if I were you is find yourself a real good lawyer right now and get on the right track to securing your and your daughters future. They would be far more knowledgable in this field and could help you more than strangers. Everyone will have their own opinion, but it is up to you to do the right thing.

Child support and custody can be pretty sticky business, all kinds of issues come into play when dealing with these matters especially if you are married. If he is the bastard you say he is use that against him. He can not just say he is going to take the child and do so at will nor can he just say he wants to visit. he would first have to go to court and request shared custody and visitation. Don't worry guys like him always get their due. as far as child support goes if you are the child's primary caregiver and you are separated then you are very definitely entitled to child support.

He does have rights. Which I don't think deadbeat dads should have. Anyway, file for divorce under reasons of desertion and infidelity. File for back child support from the time he hasn't been living with you. And ask the courts for full custody with supervised visitation for him if he decides he still wants to see your child. Contact a good lawyer that specializes in divorce/family law tomorrow!!!!! Court appointed attorneys suck. They are drowned by a heavy case load and don't care as much.

When i went for my divorce in the state of fla,my husband tried to say our son wasnt his,the judge said it didnt matter he was married to me at the time of conception and delivery so he was payin un less he wanted to pay for a paturnity test.So yes he has rights to the child,due to the facts,he is her father and you are married,better get a lawyer,Quick!Good luck God bless:O)

he has no rights at all, his name is not even on the birth certificate, you can get him for child support tho, he has not done anything for the baby so just don't sweat it! only way he can get visitions with her "if he does pay child support" but i think if he wasn't there for her when she was born or anything he wont worry about it! he has no rights at all! good luck!

You need a Attorney, each State has their own laws, this is all
civil so be carefull who you lisen to dont do something stupid and
hurt yourself and daughter later on in life. Good luck to you go to a Attorney tell him what you want and he will tell you what you can expect and do.

yes, he does since you are married and never sewed for custody rights, as of now the child is both of yours. you should consider that even if he now agrees to have nothing to do with her, he may in the future and sew you for custody rights.
